- Information on how to participate/claim and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents (excluding NT and TAS) aged 18 years or over.
- Employees (and their immediate families) of the Promoter, Participating Venues (defined below) and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The promotion will be run in up to three hundred thirty five (335) on-premise liquor licensed venues in Australia that agree to participate in this promotion and that displays promotional material advertising this promotion (each a “Participating Venue”). The promotion commences in a Participating Venue from 12.01am local time on 15/10/21 to 11.59pm local time on 14/10/22, or until stocks of scratch cards run out in a Participating Venue, whichever is first to occur (“Promotional Period”). There will be a total of up to one hundred and ten (110) Participating Venues in NSW, up to forty (40) Participating Venues in VIC, up to five (5) Participating Venues in ACT, up to one hundred and thirty (130) Participating Venues in SA, up to thirty (30) Participating Venues in WA and up to twenty (20) Participating Venues in QLD.
- To be eligible to enter, individuals must purchase a glass of Coopers Original Pale Ale in a Participating Venue during the Promotional Period (“Qualifying Transaction”) and receive a scratch card (“Scratch Card”) at the point of purchase, subject to stocks remaining in that Participating Venue. It is the responsibility of the entrants to ensure that they receive a Scratch Card at point of purchase if one is not automatically provided to them.
- Once a Scratch Card has been provided, entrants must then scratch their Scratch Card to reveal whether or not they have won an instant prize. Winner/s will be notified instantly, in writing, on the Scratch Card.
- To claim a prize, entrants must present their winning Scratch Card to a member of staff at the Participating Venue in which the Scratch Card was received. Instant win prize claims must be received at the same Participating Venue by close of business on the same day that the Qualifying Transaction was made in the Participating Venue.
- To enter the Major Prize (defined below) draw, after completing their Qualifying Transaction, entrants must complete the following steps by 11.59pm AEDST on 14/10/22:
- visit www.coopers.com.au/aussieoriginals;
- follow the prompts to the promotion entry page;
- input the requested details including first name, last name, email address, mobile phone number, postcode/suburb and Scratch Card unique code; and then
- submit the fully completed entry form.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
- Multiple entries permitted, subject to the following: (a) only one (1) entry is permitted per Qualifying Transaction regardless of the number of glasses of Coopers Original Pale Ale in excess of one (1) is purchased in that transaction; (b) a maximum of two (2) instant win entries are permitted per person per day in a Participating Venue (excluding NSW residents where a maximum of one (1) entry is permitted per person per day in a Participating Venue); and (c) each entry must be submitted separately and in accordance with these Terms and Conditions.
- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- The Major Prize (defined below) draw will take place at Immediate Pty Ltd, 111/87 Gladstone Street, South Melbourne VIC 3205 on 18/10/22 at 12:00PM AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winner will be notified in writing via email and will be published at http://winwithcoopers.com.au/winners from 20/10/22.
- The first valid entry drawn will win a $1,000 CABN gift voucher (“Major Prize”).
- Any ancillary costs associated with redeeming the gift voucher is not included. Any unused balance of the gift voucher will not be awarded as cash. Redemption of the gift voucher is subject to any terms and conditions of the issuer including those specified on the voucher itself.
- Instant win prizes awarded in each Participating Venue include:
- 5 x Coopers branded picnic blankets valued at $34.99 each;
- 30 x Coopers branded tote bags valued at $14.99;
- 50 x Coopers branded stubby holders valued at $9.99; and
- 50 x Coopers branded playing cards valued at $6.99 each.
- The total prize pool of instant win prizes for each Participating Venue is $1,473.65. The total prize pool value (inclusive of the Major Prize) is up to $192,574.50 in SA, up to $8,368.25 in ACT, up to $163,101.50 in NSW, up to $59,946.00 in VIC, up to $45,209.50 in WA and up to $30,473.00 in QLD.
- The Promoter's decision is final and no correspondence will be entered into.
- A draw for the Major Prize, if unclaimed, may take place on 19/01/23 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing via email within two (2) business days of the relevant draw. Winners will be published online at winwithcoopers.com.au/winners from 23/01/23.
- Any unclaimed instant win prizes remaining after the Promotional Period may be awarded by a Participating Venue to any customer in its absolute discretion.
- The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion, including prize claims, is subject to the licensee's liquor serving policy.
- Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem the prize at/by the time stipulated by the Promoter, then the prize will be forfeited.
- If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value.
- In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
- Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions or if the number of entries received is less than the number of prizes available, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
- Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
- The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://coopers.com.au/privacy. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
